This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Dariusz Socha ("Developer") for the SmartMTR application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.
1. Acknowledgement
This Agreement is between the User and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.
2. Scope of License
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license also allows family members who have access via Family Sharing or volume purchasing participants to use the App.
You may not distribute, sublicense, lease, reverse-engineer, decompile, or disassemble the App.
3. Nature of the App — Auxiliary Use Only
SmartMTR is an independent, hobby-developed companion application for FlexRadio 6000 and 8000 series transceivers. It is not manufactured, endorsed, or supported by FlexRadio Systems.
The App is intended solely as a supplementary visualization tool. It displays signal meter readings and related data received from your radio over the local network. The App is not a substitute for the official Maestro console or the SmartSDR software provided by FlexRadio Systems. For all transceiver safety decisions — including but not limited to transmit power levels, SWR readings, and equipment protection — you must rely exclusively on the official software and hardware indicators provided by the radio manufacturer.
4. Subscription
The App offers an auto-renewable monthly subscription. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your device's Account Settings. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
5. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind. The Developer makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
The Developer does not warrant that the App will be uninterrupted, error-free, or compatible with every firmware version or configuration of your radio equipment. Meter readings and other data displayed by the App are provided for informational purposes only and may not reflect the actual state of your transceiver.
If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damage to your radio equipment, data loss, or loss of profits, arising out of or in connection with the use or inability to use the App.
7. Maintenance and Support
The Developer may, at their sole discretion, provide updates or support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
8. Product Claims
The Developer, not Apple, is responsible for addressing any User or third-party claims relating to the App, including but not limited to: product liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.
9. Intellectual Property
The Developer is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes that third party's intellectual property rights.
"SmartMTR" is a product of the Developer. "FlexRadio", "Maestro", and "SmartSDR" are trademarks of FlexRadio Systems. All other trademarks are the property of their respective owners.
10. Legal Compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-Party Terms
When using the App, you must comply with any applicable third-party terms, including your wireless carrier's terms of service and any terms governing your use of your FlexRadio hardware.
12. Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

14. Changes to This Agreement
The Developer reserves the right to modify this Agreement at any time. Updated terms will be posted on this page. Continued use of the App after changes constitutes acceptance of the revised Agreement.
